to the Polk County Clerk of Court's & County Comptroller web site.  Polk County's Clerk of Courts has three major responsibilities: Clerk of the Circuit and County Courts; County Recorder; and Clerk, Accountant and Auditor to the Board of County Commissioners. The Clerk of the Circuit Court is the ex-officio Clerk of the Board of County Commissioners, auditor, recorder and custodian of all County funds. The Clerk is the chief financial officer for the County and serves as the County comptroller and treasurer. As Clerk to the Board, the office maintains all records pertaining to official County activities. This includes minutes of the County Commission Board meetings, copies of ordinances and all other official County documents. As Accountant and Auditor to the Board, the Clerk is charged with keeping records and making required reports of all monies received and disbursed by the Board. The Clerk is also responsible for investing surplus county funds.  We hope you take the time to learn more about us.

Passport Photos Now Offered


At our Lakeland Branch, we are now able to offer photos for those applying for a Passport. For $10 plus tax, a 2 x 2 picture can be taken which meets the requirements of the passport application.  In the near future, this service will be available at the Clerk’s Office in Bartow, as well as the Northeast Branch.   Please see the Passports section for additional information.

Simplifile eRecording Kick-Off


On November 20, from 10-11 a.m. in the Jury Assembly Room, eRecording vendor, Simplifile, will be here to demonstrate a live e-recording and show how e-recording can benefit many attorneys, title companies, etc., on recording land documents into the Polk County Official Records.   You are welcome to come check out this next phase of technology for the Clerk’s Office.

For organizations that submit documents to the Polk County Clerk of the Court Office via (express) mail, runner or courier service, the availability of Simplifile e-recording services means they are able to securely and cost-effectively file documents with the county through a web browser from the comfort and convenience of their office.

E-Recording not only saves time and money, it also accelerates document recordings, increases office productivity, and increases the security of documents filed with the county. As we will see during the kickoff meeting, most offices probably already have the equipment needed to begin submitting documents electronically.

Simplifile has partnered with Polk County to enable document submitters to be among the first to take advantage of the benefits of e-recording. Simplifile representative, Pat Sponem, will be in attendance at the kickoff meeting to demonstrate the system, show a live e-recording, and answer any questions you might have. In addition, Recording staff will present county policies and procedures for e-recording.

Clerk of Courts Warns of Scams


Polk County Clerk of the Circuit Court Stacy Butterfield warns the community of current scams.
 
Someone unlawfully impersonating a clerk’s office employee is calling local residents and threatening them with arrest.

Two citizens recently received calls from a person claiming to be from the Polk County Clerk of Courts Office. The voice mail message stated that fraud cases have been filed against them and that law enforcement would be coming out to serve an arrest warrant.  The caller left a phone number with an 888 area code.  When called, a recording said the person trying to be reached was busy with someone else.
 
According to Butterfield, “The Clerk’s Office does not contact individuals to advise a case has been filed against them or a warrant is being issued. We do not have an 888 area code. If you receive such a call, do not provide any personal information.”

“It is extremely important to remember that clerk’s office employees do not contact customers to request money or personal information. If you receive one of these calls, make sure to write down as much information as possible about the call, contact my office as soon as possible at 863-534-4000 and file a report with your local law enforcement agency,” Butterfield recommends.

Traffic Fine Payments Can Be Made at Amscot


Traffic fine payments can now be made at any of Amscot’s 174 branches, located in 15 counties.  Amscot has 12 branches in Polk County, to include Bartow, Winter Haven, Lake Wales, Auburndale, Lakeland and Haines City.  Two 24-hour locations are available, at 111 Cypress Garden Boulevard in Winter Haven and at 614 E. Memorial Boulevard in Lakeland.
           
Customers need only to bring in their payments and a record of their traffic infraction.  Amscot charges a $2.50 convenience fee for the service.  Amscot collects and aggregates the funds and automatically transfers them into the Clerk of Court’s accounts.”

Traffic Announcement


If you were charged with failing to carry your driver's license, registration, or insurance, you must provide proper proof to the Clerk of Court within 30 days of the time of the stop along with the required dismissible fee. 
If you were cited for failure to maintain proof of insurance and did not have valid insurance at the time of the stop, you may elect to enter a plea of nolo contendere and present proper proof of insurance to the Clerk of Court .  Adjudication is withheld.  This election and payment of costs must be made within the first 30 days of the stop to the Clerk of Court. 
If you pay the fine within 30 days and do not provide proper proof of insurance, OR if you pay the fine after 30 days has elaspsed, a conviction is added to your driving record.  The Department of Motor Vehicles has authority to suspend a person's license for failure to provide proof that the insurance was valid.  A notice will be sent from the department and your license will be suspended within 5 days of that notice.  You will need to contact DMV customer service for specific requirements to reinstate your license or if you have questions at 850-617-2000  or email them at CourtAssist@flhsmv.gov.

The Clerk's Office is looking for professional, high-spirited volunteers at least 16 years old to help staff with customer service, answering phones, filing, mail distribution, greeting, and other basic office duties.
